In general pre-trial
motions set the boundaries of what can and can not be presented at trial. A very
important key element in a criminal defense case.
For example what evidence will be
allowed and or not allowed, what witness will testify and or not. What can be presented
to judge and or jury at trial and or can not.
Pre-trial motions can change the course
of a criminal defendants case.
Another example would be if a defendants rights are
violated during the investigative process by the police and or any branch of law
enforcement to include the arrest, detainment and or interrogation process; this
could result in a pre-trial motion to not allow testimony, evidence and or dismiss
the case.
Case dismissed are words any criminal defendant desires to hear even more
so than not guilty.
