MIAMI-DADE LAW PRE-TRIAL INVESTIGATION
An investigation prior to going to trial is essential in being prepared for trial;
if the criminal case should get that far in the criminal judicial process.
Your criminal
defense attorney being able to know what, how, when, where and why allegedly a crime
took place you are accused is information needed to prepare a criminal court case
for defense at trial.
In any criminal court case three things can happen.
01) The charge
will be dismissed.
02) The case will be tried to verdict.
03) The defense will waive
it’s right to trial.
It is during the pre-trial investigation that a criminal court
case will be guided into one of the three above listed directions.
A pre-trial investigation,
the gathering of facts, information and evidence then compiled with theory, generally
determines the direction a criminal court case is heading.
For example during a pre-trial
investigation if information is gathered showing the defendants innocence to the
degree that it is unquestionable a criminal court case may be dismissed.
A vital and
important aspect of any criminal court case is pre-trial investigation conducted
by the State Attorney’s Office for the prosecution and your criminal defense attorney
